基于改进专利续期模型的中国专利价值测度——兼论高价值发明专利的统计特征

摘要: 专利价值可以体现不同专利的创新异质性和转化运用效果,能够更精准地揭示技术创新水平。本文结合中国专利制度特色,依据发明专利、实用新型专利和外观设计专利特征改进传统的专利续期模型,并考虑未失效专利续期时长的不可观测性,以总收益现值为口径测度中国申请授权的三类专利价值。在此基础上,对中国专利价值的总体发展状况及其内部构成展开分析,并进一步对高价值发明专利的价值特征进行解读。研究发现:专利制度建立以来,中国专利总价值的发展趋势呈现出从“低速”到“中高速”再到“高速”的阶段性特征,2001 年以后的年均增速更是达到 45.17%;三类专利的价值走势均呈显著增长态势,但实用新型和外观设计两类专利并未实现数量与价值的同步扩张;不同专利之间的价值差异巨大,表明以专利数量衡量技术创新水平具有很大程度的误导性。以价值界定的前20%的高价值发明专利主要集聚于粤、京、沪、苏、浙五省份,且省际价值规模差距悬殊;以领域界定的战略性新兴产业的高价值发明专利、新一代信息技术产业培育了超过四成的价值。

Abstract: Patent value expresses the heterogeneity of innovations, the effect of transformation and application of patents, and can more accurately reveal the level of technological innovation. This paper combines the characteristics of inventions, utility models and designs in the Chinese patent system to improve the patent renewal model, and considers the renewal proportion of unexpired patents, then estimates the value of Chinese patents based on the present value of total revenue. Thereafter, we analyze the development of patent value in China and its internal composition, and study the features of high-value inventions. The research finds that: first, the development of the total value of patents in China has shown stage characteristics from “low speed” to “medium high speed” to “high speed” since 1985, and the average annual growth rate after 2001 has reached 45.17%; second, the value of the three types of patents has shown a significant growth trend, but utility models and designs have not achieved simultaneous growth in quantity and value; third, the value between patents varies greatly, indicating that the number of patents can be misleading in measuring the level of technological innovation; fourth, the top 20% of high-value inventions defined by value are mainly concentrated in Guangdong, Beijing, Shanghai, Jiangsu and Zhejiang, and the value scale gap between the provinces is huge; fifth, among the high-value inventions in strategic emerging industries defined by fields, the new generation of information technology industry contributes more than 40% of the value.
